TERMS AND CONDITIONS

The Services offered by www.Travelcations.com (hereinafter referred to as "Travelcations") can only be used by Customers who have first read and accepted these General Terms and Conditions unconditionally by clicking on the appropriate box provided for this purpose. Proceeding with the booking process implies acceptance of these terms and conditions. Customers are obligated to fulfill the obligations contained within these terms and conditions. The agreement between Customers and Travelcations comes into force as soon as Travelcations provides written confirmation of a booking to Customers by email.

Article 1. Scope

1.1. Scope

These General Terms and Conditions apply to the offering and provision of Services by Travelcations. Travelcations operates the website, www.Travelcations.com, which serves as an interface between the Customer and various Suppliers offering the Services.

Travelcations reserves the right to change these General Terms and Conditions at any time without prior notice, though such changes will not apply to bookings already accepted by Travelcations on behalf of the Supplier(s) concerned. Therefore, it is essential for the Customer to read, save, and/or print a copy of the General Terms and Conditions at the time of booking to be aware of the applicable provisions.

1.2. Travelcations Tourism & Travel LLC

Travelcations Tourism & Travel LLC is a registered travel agency based in Dubai, United Arab Emirates.

2.1. The Customer's legal authority

The website assists Customers in finding travel products and making necessary reservations, acting as an interface for transactions with Suppliers. Customers must be at least 18 years old, legally authorized to enter into contractual obligations, have the requisite consent or authority to act for or on behalf of any persons included in a booking, and must use the website in accordance with these General Terms and Conditions.

The Customer is responsible for their activities on the website, both financially and otherwise. The Customer guarantees that the information entered on the website, including information about themselves and any traveling companions, is accurate.

Any fraudulent use of the website or actions conflicting with these General Terms and Conditions may result in the Customer being denied access to the Services offered by Travelcations and its Suppliers or other functionalities of the website.

2.2. Confirming and cancelling orders 2.2.1 Confirming

Confirmation of a booking, including essential details such as the Service(s) description and price, will be sent to the Customer via email. If the Customer does not receive a confirmation email within 24 hours of placing the booking, they should contact Customer Services at support@Travelcations.com.

It is agreed that data stored in the information systems of Travelcations and/or its Suppliers shall constitute proof of the bookings made by the Customer. Data stored electronically is valid proof and acceptable under the same conditions and with the same evidential value as a physical written document.

2.2.2 Change of booking

If the Customer wishes to change their trip regarding the date of travel, destination, place of departure, accommodation, or means of transport after making the booking, they should contact Travelcations at least 72 hours before departure/check-in. A fee or fare difference may be imposed by the applicable Supplier in the event of a change to a booking. To make changes, Travelcations may need to cancel the original booking, which may incur compensation and/or charges imposed by the Suppliers, up to the full value of the travel booked. Customers will also be responsible for the cost of a new booking.

2.2.3 Restricted Fares

Unless otherwise specified by the Customer, it is assumed that the Customer requires the least expensive Services. Such services may come with limitations and may not be modifiable. In such cases, the Services cannot be provided differently in terms of time, place, or manner than what was initially contracted.

2.2.4 Force Majeure

If an unforeseen force majeure event, which could not have been avoided even with all due care, significantly impedes, endangers, or interferes with the implementation of the trip, either party may terminate the contract. If Travelcations is affected by the force majeure, Travelcations will provide prompt assistance to Customers and take necessary measures to return Customers to the place where their package started. Additional costs of return transport will be covered by Travelcations. If Customers are affected by the force majeure, Travelcations will not be obliged to refund them any sum for services not yet performed. Customers will also be responsible for any additional costs associated with returning to the place where their package began.

2.2.5 travelcations.com Travel's Liability

Own performance. As a diligent business, Travelcations is responsible for:

  • Preparation of the trip.
  • Careful selection and monitoring of Suppliers.
  • Accuracy of the description of travel offerings displayed on the website, as long as Travelcations has not reported a change in the specifications before concluding the contract or such changes are agreed with the Customer after the contract is concluded.
  • Implementation of the travel contract.

Work for and by third parties. Travelcations is not responsible for shortcomings in arrangements brokered by parties other than Travelcations.

2.2.6 Limitation of Liability
  • Contractual limitation of liability.
    Travelcations does not limit its liability for (i) loss caused by its fraud or fraudulent misrepresentation, (ii) loss arising from death or personal injury caused by its negligence, or (iii) any other loss that may not be excluded or limited by applicable law. Otherwise, Travelcations shall be liable only for losses that arise directly: (a) from its breach of a legal duty of care, or (b) are a result of its breach of these General Terms and Conditions, and that liability is at all times limited to a sum equivalent to three times the cost of the relevant travel product.
  • Limitation of third party liability
    Claims against Travelcations for compensation are limited or excluded to the extent that international treaties or other legal regulations limiting or excluding liability apply to the arrangements provided. Liability for air transport is governed by the applicable stipulations of international treaties, including Warsaw, Montreal, and The Hague Convention, which limit the liability of air carriers for death, physical injury, and the loss or damage to baggage. Liability in the case of carriage by ship is also governed by relevant legal or treaty stipulations.
2.2.7 Lapsing of Liability and Limitation Complaints Period

Claims based on the implementation of the trip not being in accordance with the contract should be submitted within 30 days of the contractually-scheduled end of the trip. In such cases, contact support@Travelcations.com or call our service numbers. Claims should be made in writing, in the Customer's own interest. The limitation period begins on the day on which the trip should end, based on the contract.

2.2.8 Cancel and Refund

Most of our airline tickets, hotels, pre-paid car rentals, and vacation packages are non-refundable within 24 hours of the service starting date and time. We can accept refund requests only if the following conditions have been met:

  • You have applied for a cancellation and refund with us, and if the fare rules provide for cancellation and refunds.
  • You are not a "no-show" (most "no-show" bookings are ineligible for any waiver from suppliers for refund processing).
  • Once you have provided our customer service agent with your cancellation request, we will then send you an email notification that your request has been received. This notification does not automatically qualify you for a refund; it is only a confirmation of your request.

Please do not call Customer Service or write to Customer Service or a Travelcations email address for status updates regarding your refund, unless you have not received a confirmation email from us within 24 hours of making your request. Refund approval and processing times depend on the booking policies of Suppliers and third parties. Please note that the Supplier's refund policy is in accordance with the fare rules or terms and conditions established by the Supplier. Any applicable refund service fee will be deducted from the amount of the refund. Once you have cancelled your booking, please allow up to 90 days for the refund to be processed.

2.2.9 Invoicing

Travelcations is entitled to demand payment for the trip in advance. The amount paid will then be forwarded to the Supplier. When travel documents are delivered to the Customer, Travelcations is obliged to issue an invoice that fulfills legal requirements. If the Customer has a request for an invoice, they must inform Travelcations of this before the trip.

3.1.1 Nature of Services

The Services consist of enabling Customers to find travel products and services on the website and make reservations. The website offers information regarding hotels, flights, vacation packages, and other travel-related services.

3.1.2. No Representation or Warranty

Travelcations does not guarantee or represent the following:

  • The accuracy, completeness, reliability, usefulness, or availability of any information or content contained on the website.
  • The availability of any travel product or service offered by Suppliers.
  • The quality, safety, or legality of any travel product or service offered by Suppliers.
  • That Suppliers will honor their advertised prices, accept any bookings made by Customers, or fulfill any reservations made by Customers.
  • That the website will be uninterrupted, error-free, or free of viruses or other harmful components.
3.1.3. Use of Services

Customers may only use the Services for lawful and legitimate purposes. Customers are prohibited from using the Services in any manner that violates any applicable law or regulation or that could harm Travelcations or any third party.

Customers may not use the Services to engage in any of the following activities:

  • Attempting to access or use another user's account or personal information without authorization.
  • Transmitting any viruses, worms, defects, Trojan horses, or other items of a destructive nature.
  • Attempting to interfere with, disrupt, or hack the Services or the servers or networks connected to the Services.
  • Attempting to gain unauthorized access to any portion of the Services.
  • Attempting to reverse engineer, decompile, or disassemble the Services or any software used to provide the Services.
  • Using any data mining, robots, or similar data gathering or extraction methods.
  • Copying, reproducing, distributing, transmitting, displaying, mirroring, framing, scraping, or otherwise using any part of the website without prior written consent from Travelcations.
  • Impersonating any person or entity or otherwise misrepresenting your affiliation with a person or entity.
  • Violating the rights of any person or entity, including copyrights, trademarks, patents, trade secrets, and other intellectual property rights.
3.1.4. Customer Responsibilities

Customers are responsible for:

  • Providing accurate and complete information when making reservations or using the Services.
  • Ensuring that they meet all requirements and restrictions imposed by Suppliers.
  • Complying with all applicable laws and regulations, including those related to travel and immigration.
3.1.5. Account Security

Customers are responsible for maintaining the security of their accounts and passwords. Customers must immediately notify Travelcations of any unauthorized use of their accounts or any other security breach.

3.1.6. Third-party Websites

The Services may contain links to third-party websites or resources. Travelcations is not responsible for the content, products, or services offered by third-party websites or resources. Customers access and use third-party websites and resources at their own risk.

3.1.7. Feedback

Travelcations may provide Customers with the opportunity to submit feedback, comments, or suggestions regarding the Services. Customers grant Travelcations a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such feedback throughout the world in any media.

4.1.1. Intellectual Property

The website and its content, including but not limited to text, graphics, logos, images, audio, video, and software, are the property of Travelcations or its licensors and are protected by copyright, trademark, and other intellectual property laws. Customers may not use, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any part of the website or its content without the prior written consent of Travelcations.

4.1.2. Trademarks

Travelcations, the Travelcations logo, and other Travelcations trademarks, service marks, graphics, and logos used in connection with the Services are trademarks or registered trademarks of Travelcations. Other trademarks, service marks, graphics, and logos used in connection with the Services may be the trademarks of their respective owners. Customers are granted no right or license to use any trademarks or service marks owned by Travelcations or any third party.

5.1.1. Termination by Travelcations

Travelcations may, in its sole discretion and without liability to Customers, terminate or suspend Customers' access to all or part of the Services for any reason, including but not limited to Customers' breach of these General Terms and Conditions. If Travelcations terminates or suspends Customers' access to the Services, Customers will not have the right to obtain a refund for any unused portion of any travel product or service.

5.1.2. Termination by Customers

Customers may terminate their account with Travelcations at any time by contacting Customer Services. Termination of the account will result in the deactivation or deletion of Customers' account or access to the account. Termination will not entitle Customers to a refund for any unused portion of any travel product or service.

6.1.1. Governing Law

These General Terms and Conditions are governed by and construed in accordance with the laws of the United Arab Emirates. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply to these General Terms and Conditions.

6.1.2. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these General Terms and Conditions, or the breach, termination, or invalidity thereof, shall be settled by arbitration in accordance with the Rules of Arbitration of the International Chamber of Commerce (ICC).

6.1.3. Language

These General Terms and Conditions are drafted in the English language. If these General Terms and Conditions are translated into any other language, the English version shall prevail.

6.1.4. Entire Agreement

These General Terms and Conditions constitute the entire agreement between Customers and Travelcations with respect to the subject matter hereof and supersede all prior oral or written agreements, understandings, or representations.

6.1.5. Severability

If any provision of these General Terms and Conditions is held invalid, illegal, or unenforceable, the validity, legality, or enforceability of the remaining provisions shall not be affected or impaired.

6.1.6. Waiver

The failure of Travelcations to exercise or enforce any right or provision of these General Terms and Conditions shall not constitute a waiver of such right or provision.
